JCP Retention Ponds

I was happy to see the publicity about the work that the JCP POA authorized on the pond system in JCP. I found it interesting that Richard Curran-Kelly believes that the ponds are only for utility purposes. Funny how every developer and homeowner views these "Utilities" as a premium features when the price of the lot abutting the "utility" is determined! Such a simplistic view by Curran-Kelly is clearly a way for him to justify his and the POA's position.

He had a similar comment about the rash of violation notices that have recently gone out to homeowners as well. He said that the volume was no more than normal. For those of us who have lived here for many many years, we know the truth! The volume is exceedingly higher than normal. I just wish that the POA held themselves to that same standard that they hold the homeowners. In touring the development, it is clear that this is not the case. Homeowner properties are much better maintained than the common areas and they still get violation notices. And, not just one or two, but multiple. And interestingly enough, these violation notices all come in separate envelopes, multiplying the costs to the rest of us!

My biggest question is where is the accountability to the homeowners who foot the bills?

  Thank you, thank you, thank you!!!!!!  I have received numerous violation notices throughout the years, and it seems as though no matter what I do, this guy is never happy!  His notice threatens me with fines of up to $100 a day for every day I do not "fix" my problems.  Here's the deal.  He complained to me about dollarweed first, so I sprayed with Image, a St Augustine grass approved weed killer rec'd by everyone.  O.K. no more dollarweed, but the areas where it was is a little brown.  Next notice: brown patches.  I must replace with healthy green sod.  So, I redid half my lawn with new sod.  There's a problem I wasn't aware of, my sprinkler system was put in by idiots!  The whole front corner of my yard does not get wet.  Sooooo... soon there is dying sod. I had to extend a sprinkler head out there, and I am bringing the sod back to life. No matter, 2 more freakin' letters from this guy!  "Must get rid of dollarweed." There IS NO dollarweed in my front lawn, yet he sends a notice. The other is for, once again, "brown patches."  I had sprayed yet again after his notice any friggin weeds that didn't look like grass.  I'm sorry, I just can't afford to keep replacing sod.  I bug kill and use weed and feed, cut my grass every week. I don't have the time or money to maintain a golf course lawn.  My lawn is neat and manicured, but not perfect. It seems there's no pleasing this guy!  I realize there are those out there who are going to say "Well, I signed the covenants, those are the rules."  I agree, but there is a fine line, and I feel he's bordering on harrassment.  I see MANY houses on my street alone that have noticeable weeds, brown and/or bare patches.  I wonder, honestly folks, no names, but are you getting notices also?  There has to be something we can do.  I understand, many people ENJOY keeping up a golf course lawn, that's fine.  However, please understand, many also don't have the time or finances to enjoy the same things as you do.  Does anyone know of any legal means to get him to lay off and give us homeowners a chance to care for our lawns, other than his demands of replacing sod ever f'ing week?  I also find it ironic as doggielover stated, that the developers tout the "lakefront" homes with premiums when selling the lots.  In all honesty, it is true.  The "lakes" are functioning catch basins, nothing more, nothing less.  When they start taking on that "natural" look, with vegetation and weeds on the bottom, becoming shallow enough to see the bottom, they are FAILING!  That is what is called eutrophication, when nature reclaims the land.  If this happened, the storm runoff would have no place to go except into our streets and ultimately, our homes!  I thought too that it was a crime what was happening, but I spoke to a friend of mine,retired from the Army Corps of Engineers.  He bluntly said that basically, people paid a premium to live with a sewer in their backyards!  I don't know what the answer is here, but I think the anger should be directed towards the developer who sold the lots as such.  If the ponds are not maintained correctly, HOWEVER that is defined, we will flood.  Plain and simple.

The pond issue stinks big time.  The two by my home are in horrible condition,  murky water, lots of garbage floating in them, just not at all what they were a few years ago. I was very happy to see the write up about it.  I do wish they had provided more information though as to how to get a signature on the petition.  I will have to look into that, if anyone on here knows please share, I would love to have some say when it comes to this, especially since it seems like the contractor is being sole sourced because he has an in with the board that approves this work in the first place.

 

Violations - Maybe, just maybe you are receiving violation notices because one of your neighbors are calling and complaining, not because it is valid since you are trying to fix the issue, just because they have nothing better to do? Maybe though it is Richard Curran-Kelly because I have noticed an extreme turn around in my neighborhood, it was getting really bad with all sorts of legitimate violations, to the point where I was embarrassed to have anyone over. It all seems much better in the past several months.  (With the exception of the big male body part that was spray painted on one of my neighbors’ front and garage doors over the weekend)

The board is probably counting on you the stakeholders to not show interest in this.  If that happens we deserve what we get.  We are trying to ensure that at least you know what has happened and what is going to happen.
